Terms of Service

1. Agreement Structure
These Terms of Service ("Terms") govern the use of Zirelia ("Software"), an open-source autonomous AI virtual
influencer engine developed by Antonio Trento ("Author"). By downloading, installing, or running the
Software, you ("User") agree to be bound by these Terms and by the
Elastic License 2.0 (ELv2) under which the Software is distributed.
2. License Grant
The Software is provided under the Elastic License 2.0 (ELv2). You are granted a
non-exclusive, worldwide, non-sublicensable, non-transferable license to:
- Use, copy, and modify the Software for personal use or internal business operations.
- Distribute the Software to third parties, provided you include this license and do not circumvent its
conditions.
You may NOT:
- Provide the Software to third parties as a hosted or managed service where they do not control the
infrastructure.
- Circumvent any license key, feature flag, or similar protection in the Software.
3. AI Disclaimer — Autonomous Content Generation
Zirelia uses large language models (LLMs) and image generation systems to produce content autonomously.
You acknowledge and agree that:
- AI-Generated Content: All text and images produced by the Software are generated by
AI models (e.g., OpenAI GPT-4, FLUX.1). The Author cannot guarantee accuracy, appropriateness, or
compliance of this content with any law or platform policy.
- Hallucinations & Errors: AI models may produce factually incorrect, offensive, or
legally problematic outputs. You are solely responsible for reviewing content before it is published.
- Visual Identity: AI-generated images may unintentionally resemble real individuals.
You must ensure that generated content does not violate applicable laws regarding likeness, defamation,
or synthetic media (deepfakes).
- No Liability for AI Output: The Author shall NOT be liable for any damages, legal
claims, reputational harm, or losses arising from content generated or published by the Software.
3-bis. Synthetic Identity, Likeness & AI Model Provider Liability
⛔ REAL PERSON IMPERSONATION IS STRICTLY PROHIBITED
Using Zirelia to create virtual personas that replicate, imitate, or are inspired by the identity,
image, voice, or recognisable traits of real people is
expressly prohibited, unless the User has obtained
explicit written consent from the individual being represented. Specifically:
- Prohibition of Real Identity Reproduction: It is strictly forbidden to configure
the Software (via YAML files, LoRA models, prompts, or any other method) to generate content that
represents, imitates, or could reasonably be confused with a real natural person, living or deceased,
without that person's written consent (or consent from their heirs/legal representatives).
- AI Model Provider Liability for Unintentional Resemblance: Images generated by
the Software are produced by third-party AI diffusion models (including, but not limited to,
FLUX.1, SDXL, provided by Replicate Inc. and the respective model developers).
The Author of Zirelia has no control over the training data, weights, or outputs
of these models. If a generated image unintentionally resembles a real person, the technical
responsibility lies solely with the AI model provider (Replicate Inc. and/or the
specific model developer) and not with the Author of Zirelia, who provides only
the orchestration software.
- Compliance with Synthetic Media (Deepfake) Laws: The User is required to comply
with all applicable laws and regulations regarding AI-generated synthetic media, including but
not limited to:
- Italy: Art. 494 Criminal Code (identity substitution), Art. 10 Civil Code
(right to likeness), Legislative Decree 196/2003 and EU Regulation 2016/679 (GDPR)
- European Union: EU AI Act (Regulation 2024/1689), Art. 50 — transparency
obligation for AI-generated content
- International: All locally applicable laws on deepfakes, right of publicity,
defamation, and identity theft in the User's jurisdiction
- Mandatory AI Labeling: In compliance with the EU AI Act and industry best practices,
the User must clearly indicate that content published by the virtual persona is
generated by artificial intelligence (e.g., by stating "AI-generated" or "AI-created content"
in the social media profile bio or in the posts themselves).
- Indemnification Clause: The User agrees to indemnify, defend, and hold harmless
the Author, collaborators, project contributors, and affiliates from and against any and all claims,
damages, costs (including legal fees), liabilities, or legal actions brought by third parties in
connection with: (a) the User's use of the Software; (b) content generated and/or published by the
User through the Software; (c) infringement of intellectual property rights, likeness rights, or
personality rights of third parties; (d) violation of any applicable law or regulation.
- No Affiliation with Third-Party Providers: Zirelia is an independent project.
The Author is not affiliated with, sponsored by, endorsed by, or in any way
connected to Replicate Inc., Black Forest Labs (FLUX.1), Meta Platforms Inc., OpenAI Inc.,
X Corp., Anthropic PBC, or any other AI service provider or social media platform. All trademarks
mentioned belong to their respective owners.
4. Social Media Platform Compliance
Automated posting to social media platforms (Twitter/X, Instagram, etc.) may violate those platforms'
Terms of Service. You acknowledge that:
- You are solely responsible for ensuring your use of the Software complies with the ToS of any
connected platform.
- The Author does not encourage or endorse violations of third-party platform policies.
- Account suspensions, bans, or legal actions by platforms resulting from use of the Software are
your sole responsibility.
- "Salesforce", "Twitter", "X", "Instagram", "Meta", "OpenAI", "Anthropic", "Replicate" are trademarks
of their respective owners. Zirelia is not affiliated with, endorsed by, or supported by any of these
companies.
5. Data Handling & Privacy
Zirelia is a self-hosted, stateless Software. The Author does not collect, store, or
have access to any data processed by your instance. Your API keys, persona configurations, and generated
content reside exclusively on your own infrastructure. See our Privacy Policy

6. GDPR & Marketing Consent
This website (zirelia.github.io) may collect minimal data via cookies for analytics purposes. By
continuing to browse the site, you consent to the use of cookies as described in our
Privacy Policy. You may withdraw consent at any time by clearing your
browser cookies. We do not use your data for targeted advertising.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE AUTHOR BE LIABLE FOR ANY
INDIRECT, CONSEQUENTIAL, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF DATA, REVENUE,
PROFITS, OR BUSINESS OPPORTUNITIES) ARISING OUT OF OR RELATED TO YOUR USE OF THE SOFTWARE, EVEN IF
ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE AUTHOR'S TOTAL CUMULATIVE LIABILITY SHALL NOT EXCEED
€100 (ONE HUNDRED EUROS).
8. Disclaimer of Warranty
THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT
LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
USE THE SOFTWARE AT YOUR OWN RISK.
9. Governing Law & Jurisdiction
These Terms shall be governed by the laws of the Republic of Italy. Any disputes arising
from interpretation or enforcement of these Terms shall be subject to the exclusive jurisdiction of the
Court of Milan (Tribunale di Milano). For international users, nothing in these Terms
limits your rights under applicable mandatory consumer protection laws in your country of residence.
10. Changes to Terms
The Author reserves the right to update these Terms at any time. Continued use of the Software after
changes are published constitutes acceptance of the updated Terms. The effective date at the top of this
page indicates the last revision.
